1. Status report has been filed on behalf of the respondent no.1/MCD, wherein it is stated as under: i. The subject property has been booked for unauthorized construction on 22nd April, 2026 in the shape of ground floor and first floor and a show-cause notice has been issued on the same date. ii. A letter dated 24th April, 2026 has been sent to the SHO, Police Station – Neb Sarai requesting that the unauthorized construction be This is a digitally signed order. W.P.(C) 5422/2026 stopped immediately. iii. A letter dated 24th April, 2026 has been send to the Electricity Department for disconnection of electricity and water supply. iv. A letter dated 24th April, 2026 has been send to the Sub-Registrar with a request not to register any transaction in respect of the subject property.
2. In view of the aforesaid status report, the present writ petition is
disposed of while directing the respondents to take action in accordance with law.
3. The respondent no.2/SHO P.S.: Neb Sarai, New Delhi, shall ensure that no unauthorised construction is carried out till the show-cause notice is adjudicated.
4. Pending application stands disposed of.
5. Liberty is given to the petitioner to initiate appropriate proceedings in law in the event any further grievance survives.
6. All rights,
contentions and legal remedies of the owner/occupier/private respondent no.3 are kept open.
