Learned advocate appearing for the petitioner submits that the subject-matter of the case relates to recovery of 23 kgs. of ganja, but the petitioner was arrested on the basis of statement of co-accused. Petitioner is in custody for 111 days. As such, he may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that commercial quantity of contraband has been seized. Having considered the fact that the investigation of the case is still in progress, at this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after the charge-sheet is submitted before the jurisdictional court.
2 The application for bail, being CRM (NDPS) 37 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
