2026:HHC:8378 IN THE HIGH COURT OF HIMACHAL PRADESH AT SHIMLA CMP(M) No.1776 of 2025 in Review Petition No.16 of 2026 Decided on: 20.03.2026. __________________________________________________________ UCO Bank ...Petitioner Versus Asim Chaudhary ...Respondent Coram Hon’ble Mr. Justice G.S. Sandhawalia, Chief Justice Hon’ble Mr. Justice Ranjan Sharma, Judge 1Whether approved for reporting?. For the petitioner: Mr. Sanjay Dalmia, Advocate. G.S. Sandhawalia, Chief Justice [Oral] The present Review Petition has been filed seeking review of the judgment passed in LPA No.253 of 2025, decided on 26.05.2025. In the Review Petition, the petitioner-Bank has placed on record the Revised Transfer Policy [Annexure RP-3], seeking to raise new grounds which have arisen subsequent to the decision of the learned Single Judge, which was upheld by this Court. The said grounds also pertain to developments subsequent to the filing of the writ petition and the rights of the employee existed at the relevant point of time, and thus would have no bearing on merits now. 1 Whether reporters of Local Papers may be allowed to see the judgment? 2026:HHC:8378 - 2 - 2. In such circumstances, we are of the considered opinion that no ground is made out to review the order passed by this Court in open Court in the presence of learned counsel for the Bank. It is a settled principle of law that under the guise of a review petition, the matter cannot be re-argued, as the jurisdiction of review is limited to cases where there is an error apparent on the face of the record. The issue involved being one of transfer, wherein the learned Single Judge has exercised jurisdiction, does not warrant interference. 3. Accordingly, we find no error apparent on the face of the record warranting interference. The application for condonation of delay [CMP(M) No.1776 of 2025] is allowed; however, the Review Petition is dismissed. (G.S. Sandhawalia) Chief Justice (Ranjan Sharma) Judge March 20, 2026 [Shivender/Bhardwaj]
