The petitioner has approached this Court praying for a direction upon the respondent authorities to correct the alleged erroneous recording in the record of rights in respect of Khatian No. 2063, JL no. 2, within Mouza Samonti, in the District of Howrah. Mr. Banerjee, learned Advocate appearing for the State submits that the petitioner has, in effect, challenged the order passed by the prescribed authority under Section 50 of the West Bengal Land Reforms Act in this writ petition. He submits that such an order is appealable order under the provisions of Section 54 of the West Bengal Land Reforms Act, 1955. He further submits that if the petitioner is aggrieved by any action of an authority under the specified Act, the petitioner ought to have approached the West Bengal Land Reforms and Tenancy Tribunal against any decision of an authority under the West Bengal Land Reforms Act, 1955 which is a specified Act under Section 2(r) of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997. In reply, Mr. Pan, learned Advocate for the petitioner submits that it is only an order passed under Section 51B of the West Bengal Land Reforms Act, 1955, which is an
appealable order under Section 54 of the 1955 Act. Faced with such situation, Mr. Pan, learned Advocate appearing for the petitioner prays for leave to withdraw this writ petition with liberty to approach the West Bengal Land Reforms and Tenancy Tribunal. In the light of the said prayer WPA 29188 of 2025 stands dismissed as withdrawn with liberty to the petitioner to approach the West Bengal Land Reforms and Tenancy Tribunal. If such an approach is made by the petitioner within a period of four weeks from the date of receipt of the server copy of this order, the learned Tribunal shall consider the same without dismissing the same on the point of limitation. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
