The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 64(1), 351(2) of B.N.S. 3. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any office. Learned counsel further submits that the informant has lodged FIR making false allegation and suppressing her relation with the petitioner and informant used to talk with the petitioner over phone and the fact that several times she has taken loan from the petitioner. He further submits that charges have been framed. He further submits that petitioner is languishing in custody since 14.11.2025; as such, the petitioner may be enlarged on bail. Learned counsel further submits that the petitioner is ready to abide by every condition imposed by this court. 4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner. 5. Having regard to the aforesaid coupled with fact incorporated in para-144, which is the medical report, which has not supported the case of prosecution and also the fact that seizure of vehicle has done from the house of the informant itself and also the fact that the victim and the petitioner were having relationship and the informant has taken loan several times from the petitioner and refused to repay the same; I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner 2026:JHHC:7608 2 is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of Sri Kamlesh Behra, Judicial Magistrate, 1st Class, Nagar Untari, Garhwa, in connection with Dhurki P.S. Case No. 108 of 2025. 6. It is made clear that the petitioner shall appear on each and every date before the learned trial court and if any adverse report will come against the petitioner, learned trial court shall be at liberty to cancel the bail of the petitioner.
