Rakib CRM (NDPS) 1355 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Dankuni Police Station case no. 381 of 2023 dated 12.12.2023 under Sections 20(b)(ii)(C) and Section 25/29 of the of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In the matter of : Mahabub Mondal ……Petitioner. Mr. Tapas Kr. Ghosh Mr. Tanmoy Chowdhury ……for the Petitioner. Mr. Avishek Sinha ……for the State. Learned advocate appearing for the petitioner submits that he is the driver of a truck who has been implicated in connection with alleged recovery of 150 kgs of ganja. It has further been contended that the petitioner is in custody for two years one month and till date only one witness out of 11 witnesses cited in the charge-sheet has been examined. As such on any stringent conditions petitioner may be released on bail. Learned advocate for the State has submitted a report which reflects that delay was contributed by both the parties. However the report also reflects that the prosecution presently intends to examine another five witnesses. It has been pointed out that the next date is on and from 20th February, 2026. Having regard to the period of detention of the present petitioner, a last opportunity is granted to the prosecution to conclude the evidence of the five witnesses within three months 2 from 20th of February, 2026. In case the prosecution is unable to conclude the evidence within the aforesaid period, learned trial Court would release the petitioner on such terms and conditions as he deems fit and proper. With the aforesaid directions CRM (NDPS) 1355 of 2025 is disposed of. Report so submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
