THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE E.S.INDIRESH ORAL ORDER 1. Heard learned counsel appearing for the parties. 2. In this petition, it is the case of the petitioner that petitioner-College has been duly affiliated with the respondent No.2-University, and has been conducting Nursing Courses since the Academic Year 2021-2022. It is to be noted that the recognition has been granted by the respondent No.1- Government as per Annexure-A. It is stated that, the said - 6 - HC-KAR NC: 2026:KHC:17119 WP No. 15829 of 2025 recognition or affiliation cannot constitute a valid ground for withholding the continuation of affiliation for the Academic Year 2024-2025. In this regard, perusal of the Government Order(Annexure-E2), dated 06.09.2023, would indicate that certain conditions have to be strictly adhered to and fulfilled by the petitioner-Institution. Taking into consideration the fact that, now the Academic Year 2025-2026 is yet to be started by the petitioner-Institution, it is open for the respondent- Government to make an inspection of the petitioner-Institution at the earliest and to take decision in the matter as to the adherence of any further Notification being issued by the Government in so far as the eligibility of the petitioner- Institution to continue the affiliation as such. 3. In that view of the matter, liberty is reserved to the respondent-Government to make one more inspection as to consider the admission of the students for the Academic Year 2025-2026. The Order dated 17.09.2024 (Annexure-K) issued by respondent No. 2 is hereby set aside and respondent No. 2 is hereby directed to continue the affiliation of the petitioner - Institution for the Academic Year 2024-2025 and further issue - 7 - HC-KAR NC: 2026:KHC:17119 WP No. 15829 of 2025 approval for the admission of students who have been admitted by the petitioner-Institution for the Academic Year 2024-2025. It is also noted that in the event of not pronouncing the results of the students of the petitioner- Institution, respondent No.2 is directed to announce the results of the students for the Academic Years 2023-2024 and 2024-2025. However, it is made clear that, it is open for respondent No.2-University to conduct fresh inspection as to the feasibility of the petitioner- Institution for continuation of the affiliation/recognition is concerned for the Academic Year 2025-26. 4.
