Mr. Pradip Kumar Mondal Mr. Arka Mondal ….for the petitioner Mr. Chandi Charan De, AGP Ms. Chandana Ghosh ….for the State Affidavit of service filed in Court today is taken on record. The petitioner alleges that the private respondent respondents have made an unauthorised construction by encroaching upon a portion of the PWD road running adjacent to the property of the petitioner. The learned advocate appearing for the petitioner submits that in spite of receipt of a representation praying for removal of encroachment from the PWD road, no steps have been taken by the respondent authorities. Mr. De, learned Additional Government Pleader draws the attention of the Court to the representations annexed to the writ petition and submits that the petitioner has prayed for action to be taken under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 and the West Bengal Public Land (Eviction of Unauthorised Occupants) Act, 1962. He submits that from the representation it is not clear as to the nature of encroachment that has been made. 2 Faced with such situation, the learned advocate for the petitioner prays for liberty to file a comprehensive representation before the competent authority. Such prayer is not opposed by Mr. De, learned Additional Government Pleader. In the light of the submissions made by the learned advocate for the respective parties, WPA 7248 of 2026 stands disposed of by giving liberty to the petitioner to submit a comprehensive representation ventilating her grievances before the appropriate authority. If such a representation is submitted, the concerned authority shall consider and dispose of the same in accordance with law as expeditiously as possible. There will be no order as to costs.
