Kausik (Allowed) CRM (NDPS) 423 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bhagwangola Police Station Case No. 301 of 2024 dated 22.06.2024 under sections 21(c)/29 of the NDPS Act, 1985. And In the matter of : Yousuf Ali @ Insuf Ali ……Petitioner. Mr. Arnab Chatterjee Mr. Anisur Rahaman ……for the Petitioner. Mr. Joydeep Biswas Mr. Rahul Ganguly ……for the State. Learned advocate appearing for the petitioner submits that pursuant to the anticipatory bail being rejected, petitioner surrendered before the learned Trial Court on 07.01.2026 and since then is in custody. Charge has been framed. According to the petitioner, at the time when the anticipatory bail was preferred, the prosecution submitted that petitioner is the owner of a motorcycle for which he is wanted in connection with the said case. On the other hand, from the documents which have been relied upon by the prosecution, it would reveal that petitioner’s brother happen to be the owner of the motorcycle. 2 Learned advocate for the State submits that the prosecution case is that, all the accused persons absconded leaving behind the motorcycle. There were seizure of 337 bottles of Phensedyl and the case was registered on 22.06.2025 when the alleged seizure took place. Having considered the fact that, good sense prevailed on the petitioner, as he surrendered before the learned Special Court and the prosecution intends to examine 15 witnesses, I am of the view as there is less possibility of the trial concluding very soon, petitioner may be released on bail. As such the prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Yousuf Ali @ Insuf Ali, shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Additional District & Sessions Judge, 2nd Court cum Judge Special Court under NDPS Act at Murshidabad at Berhampore. If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 423 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
