ORAL ORDER
This civil petition is filed by the wife for transfer of M.C.No.58/2025, filed by the husband for restitution of conjugal rights, from the Court of Senior Civil Judge and JMFC, Pandavapura to the Court of Principal Senior Civil Judge, Hunsur.
2. The petitioner/wife has stated that she is residing in Harohalli Village, Hunsur Taluk and their marriage was solemnized in the year 2021 and they were blessed with a girl child in the year 2022. The petitioner/wife is residing with her parents at Hunsuru and she is not working or earning.

3. The petitioner stated that there is no direct bus to Pandavapura and she has to first reach either yelwal or Bilikere, which is situated on the Mysuru-Mangalore High way, at a distance of 15 kms from her village and from there she has to take another bus to reach Pandavapura and one side journey alone would take 2 to 3 hrs. There is no independent source of income. It is stated that respondent is an agriculturist and he is residing in Pandavapura.
4. Notice was issued to the respondent; but there is no representation on behalf of the respondent. Learned counsel for the petitioner further stated that when he appeared before the Family Court, a copy of the petition was also served upon him and he filed a memo to that effect. Therefore, despite having knowledge of the proceedings, he has neither appeared nor made any representation before this Court. Hence, considering the argument of the learned counsel for the petitioner, this Court finds it reasonable to transfer M.C.No.58/2025 from

the Court of Senior Civil Judge and JMFC, Pandavapura to the Court of Principal Senior Civil Judge, Hunsur, as it is inconvenient for the petitioner to travel all the way along with a minor child. Accordingly, the civil petition is allowed.
