JUSTICE SOUMITRA SAIKIA ORDER 17.06. 2026 Heard Mr. J. Chutia, learned senior counsel assisted by Ms. S. Kemprai, learned counsel for the petitioner. Mr. D. Borah, learned counsel appearing for all the respondents. 2. The petitioner was serving as a Research Assistant in office of the Deputy Commissioner, Dibrugarh. Subsequently, he was promoted to the post of Assistant Planning Officer and during his service he was regularized under the Deputy Commissioner, Majuli. While rendering services under the Deputy Commissioner, Majuli, a departmental proceeding was initiated and charges were framed against the petitioner. Upon completion of the enquiry, the Disciplinary Authority by order dated 23.06.2025 imposed a major penalty of dismissal from service. Being aggrieved thereby, the petitioner has preferred an appeal on 29.08.2025 under the Assam Services (Discipline & Appeal) Rules, 1964. However, till date as per the information available to the petitioner, the appeal has not been disposed of. Page No.# 3/3 3. The learned senior counsel at this stage submits that the limited prayer of the petitioner is for a direction to the Secretary of the Department through whom the appeal was routed, to dispose of the appeal as expeditiously as possible. 4. Mr. D. Borah, learned counsel appearing for the respondents submits that at this stage he has no instructions as to whether the appeal has been disposed of. 5. Considering the submissions made by the learned counsel for the petitioner, this writ petition stands closed, directing the respondents authorities, more particularly Respondent No. 2 and 4 to expeditiously consider the appeal preferred by the petitioner and pass appropriate orders thereon, if not already been done, within a period of 60 days from the date of receipt of certified copies of this order. 6. Needless to say, any order that may be passed by the Appellate Authority, copies thereof shall be served upon the petitioner. 7.
