07/06.05.2026 Heard the learned counsel appearing on behalf of the parties.

Learned counsel for the petitioner submits that the petitioner is in custody in connection with Manika P.S. Case No. 57 of 2025, corresponding to Spl. POCSO Case No. 35 of 2025 for the offences registered under Sections 65(1) of the B.N.S. 2023 and section 4/6 of the POCSO Act, pending in the court of learned Special Judge, POCSO at Latehar.

Learned counsel for the petitioner submits that though the petitioner is named in the FIR, but there is no allegation of forceful sexual intercourse with the victim and the petitioner is in custody since 10.06.2025.

Learned counsel for the opposite party-State has opposed the prayer and has submitted that the victim was only 14 years of age and the petitioner is aged about 21 years and considering the direct allegation against the petitioner, he may not be enlarged on bail. He has also submitted that as per the impugned order, the victim has fully supported the prosecution case.
5. After hearing the learned counsel for the parties and considering the direct allegation made against the petitioner, this court is not inclined to enlarge the petitioner above named on bail. Accordingly, prayer for bail of the petitioner above named is rejected.
6. However, the petitioner is in custody since 10.06.2025 and certainly the trial is required to be expedited.
7. State is directed to ensure that the witnesses are promptly produced before the court.

8. The learned counsel for the State is directed to communicate this order to the Director, Prosecution and also to the Superintendent of Police of the concerned District to ensure compliance.
