This appeal under Section 14-A(2) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989 is filed against impugned order dated 28.11.2025 in Crime No. 483/2025 passed by learned Special Judge (Atrocities Act), District- Raigarh (C.G.) whereby appellants’ application filed under Section 483 of BNSS for grant of bail is rejected. Vide order dated 04.02.2026, the first bail application filed by the appellant and other co-accused persons was dismissed as withdrawn with respect to the appellant. 3. Appellant is in jail since 31.10.2025 in connection with Crime No.483/2025 registered at Police Station- Chakradhar Nagar, District- Raigarh (C.G.) for the offence punishable under Sections 296, 299, 302, 352, 3(5) of BNS and Section 3(1)(Q) of SC/ST Act equivalent to Section 3(1)(v) of SC/ST Act (wrongly mentioned as 3(2)(Q) of SC/ST Act) and Section 66 (p) (2) of the Information Technology Act. 4. Case of prosecution, in brief, is that complainant namely Ajay Kumar Bhardwaj filed a written report dated 30.10.2025 stating that in their Satnami Samaj whatsapp group i.e. Pragatisheel Satnami Samaj, District- Raigarh, a video was posted by a member namely Shivkashi, mentioning that the person visible in the video is Vijay Rajpoot/Appellant herein, and in the said video, abuses have been made to their religious leader Baba Guru Ghasidas Ji and as such, their religious sentiments have been hurt. Further, voices of some other persons are also audible in the video, who are instigating Vijay Rajpoot to make abuse and to use abusive words. On the basis of the written report to this effect, an FIR was registered. 5. Learned counsel for the appellant submits that appellant is innocent and has been falsely implicated in the case. He further submits that vide order dated 10.04.2026, the complainant had appeared through video conferencing through concerned DLSA and he has not raised any objection. He further submits that the first bail application filed by the appellant along with other co-accused persons was dismissed as 3 withdrawn with respect to the present appellant vide order dated 04.02.2026 and hence, the same has not been decided on merits, however, the bail application of the other co-accused persons were allowed by this Court. He further submits that at this stage, charges have been framed against the appellant but no prosecution witnesses has been examined. As such, the trial is likely to take some more time, therefore, the appellant may be granted bail. 6. Learned State Counsel objected the prayer stating that in the order rendered by the Trial Court all incriminating circumstances are against the accused/appellant which connects him with the crime and chain of circumstances are fully linked and completed with each other. 7. Heard counsel for respective parties and perused the documents available on record. 8. Upon considering the entire facts and circumstances of the case and the nature of the allegations, and the facts that appellant is in jail since 31.10.2025, co-accused persons have been granted bail by this Court vide order dated 04.02.2026 passed in CRA No.2665/2025, further the complainant has not raised any objection with regard to grant of bail to the appellant herein, this Court is inclined to grant bail to the appellant and allow the present appeal. 9. Accordingly, the appeal is allowed. Impugned order dated 28.11.2025 is set aside. It is directed that appellant Vijay Rajpoot shall be released on regular bail upon his furnishing a bail bond in sum of Rs. 20,000/- with one surety in the like sum to the satisfaction of the Court on the conditions that:- 4 a) Appellant shall appear before trial court and participate in the trial proceedings, unless exempted from appearance.
