This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.5/2026 registered at Police Station – Bhilai Bhatti, District- Durg (C.G.) for the offences punishable under Sections 75(1)(1), 78(1)(1) of BNS, 2023. 2. Case of the prosecution, in brief, is that that the complainant, lodged a written report that she is living with her son and do private job to sustain their life after her husband abandoned them. Accused is a VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.02.05 15:27:06 +0530 2 familiar to her and initially she get help of accused for her personal work. But when she feels that accused see her from different angels due to her loneliness when he started touching her body and praise her without any reason. After then she stopped contacting with accused and taking his help. On 03.01.2026 at 09:30 PM she was going to market with her friend on the way accused stopped them when she asked accused why he stopped her, accused started touching her shoulder and with bad intention and asked that he loves her and cannot live without her. He also threatened her that if she not accepts his proposal, he falsely implicate her son in criminal case and also harass her father. Accused regularly follow her wherever she go and mentally torture her, Based on the complainant written report, a F.I.R has been registered against the applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. He would submit that complainant itself stated that she has no objection while granting anticipatory bail to the applicant . It is further contended that now there is no dispute between the complainant and the present applicant, further applicant is aged about 54 year old person and investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 3 6. Considering the facts and circumstances of the case, the gravity of the offence, and the allegations levelled against the applicant, and further considering that complainant has no objection while granting anticipatory bail to the applicant, applicant is aged about 54 years old and also taking into consideration that the investigation and trial are likely to take considerable time, this Court is inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Shesh Narayan Sharma on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
