Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioners in connection with Special G.R Case No.28 of 2025 pending in the file of learned Additional Sessions Judge-cum-Special Judge, Sonepur arising out of Tarava P.S. Case No.228 of 2025 on the grounds stated. 3. Perused the FIR as at Annexure-1. The informant is the father of the victim and he lodged the report. The allegation is that the victim’s daughter was kidnapped by the principal accused and the petitioners assisted at the time of such kidnapping. In course of hearing, learned counsel for the petitioners produced the statements of the victim and two others including the informant recorded under Section 180 BNSS. From the FIR i.e. Annexure-1, the Court finds that the victim was allegedly kidnapped by the principal accused and p. 2 his friends. It is also made to reveal from her statement under Section 180 BNSS that she stayed with the principal accused for about two months but was ill-treated during such stay. The petitioners are the uncle and aunt of the principal accused and they apprehend arrest in the hands of the local police since their involvement is alleged for having assisted in the kidnapping of the minor victim. Considering the FIR i.e. Annexure-1 and the statements of the witnesses including the victim and limited role alleged to have been played by the petitioners assisting the kidnapping, this Court though not inclined to grant any of them pre-arrest bail but is of the view that they should be directed to surrender before the learned court below to be released with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid.
In the event, the petitioners surrender before the court of learned Additional Sessions Judge-cum- Special Judge, Sonepur within a period of fifteen days from today, it is directed that they shall be released on bail in connection with Special G.R Case No.28 of 2025 corresponding to Tarava P.S.
