Order No.
ORDER 22.04.2026
01. 1. Heard learned counsel for the petitioners and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Derabish P.S. Case No.97 of 2025 corresponding to G.R. Case No.303 of 2025 pending in the file of learned J.M.F.C.(C.T.), Kendrapara on the grounds stated. 3. Perused the FIR as at Annexure-1. It is informed to the Court that the chargesheet is filed. A copy of the chargesheet is also produced by learned counsel for the petitioners. It is claimed that the petitioners and informant are not in good terms. The further submission is that even though there is allegation of similar mischief committed by the petitioners, earlier no FIR was lodged by the informant, hence, considering the same and nature of allegations in the FIR and as there has been closure of investigation in the meantime, the petitioners should be granted bail if not pre-arrest bail with a direction for p. 2 them to surrender before the learned court below for being released with conditions. Recorded the objection of the State. The alleged incident took place in the month of June, 2025. The petitioners were not arrested in connection with case during investigation. On a reading of the FIR, the Court finds that the petitioners did the mischief and misbehave the informant, who is a married lady aged about 35 years and even assaulted her. But from the chargesheet, it does not appear that the informant received any external injury for the assault by the petitioners. It is made to understand that there is a dispute between the parties for quite some time, hence, the alleged incident, for which, the report was lodged by the informant. Considering the allegations in the FIR and the fact that there is completion of investigation with filing of the chargesheet, the Court is inclined to direct the petitioners to surrender instead as it is not a case of pre-arrest bail for being released with stringent conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid.
It is further directed that in the event, the petitioners surrender before the court of learned J.M.F.C.(C.T.), Kendrapara in connection with Derabish P.S. Case No.97 of 2025 corresponding to G.R. Case No.303 of 2025 within a fortnight from today, they shall be released on bail upon furnishing a bail bond of Rs.40,000/-(rupees forty thousand) each with one solvent surety for the like amount each with other conditions imposed. It is further directed that the petitioners shall furnish an undertaking to the effect that they p. 3 shall not cause any harm to the informant in any manner whatsoever, while on bail. It is made clear that in case any such conditions imposed by this Court or by the learned court below is/are violated, it shall entail cancelation bail granted to the petitioners without reference to this Court. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge
