The matter is listed for orders on Letter dated 29.01.2026 sent by the District and Additional Sessions Judge, FTC, Special Judge (POCSO), Katghora, District-Korba (C.G.) requesting for extension of further some time for disposal of the case bearing Special (POCSO) Case No. 06/2023 (“State of Chhattisgarh Vs. Budhwar Singh Tirkey.”). 2. On 14.08.2025 while disposing of the MCRC No.5626/2025 this Court had directed the concerned Court to decide the case within a period of four months but the proceeding could not be completed within four months. It is also informed through the SOURABH PATEL Digitally signed by SOURABH PATEL Date: 2026.02.26 11:32:28 +0530 2 said letter that the evidence of 10 witnesses has been recorded, and the evidence of Investigating Officer Inspector Avinash Singh (I.O.) and witness Sant Kumar Maravi is yet to be recorded. Despite repeated summons and warrants, Avinash Singh has failed to appear to record his evidence. The non- appearance of an I.O. despite repeated summons and warrants is a serious lapse that severely undermines the prosecution’s case. Despite trying for almost one year, the aforesaid prosecution witnesses have not been examined till date, therefore, the negligence of the prosecution and the district police administration is disappointing. By the Letter under consideration, the concerned Court has prayed to grant further time for deciding the case. 3. The request made by the learned concerned Court appears to be genuine and, therefore, further 02 months time is granted from the date of receipt of copy of this order to ensure disposal of the case. 4. The concerned Judge is directed to make all the endevour for disposal of the case within stipulated time. The prosecution wing is expected to fully co-operate in concluding of the trial. Registry is directed to send the copy of this order to the concerned Court, District Magistrate, Superintendent of Police and Inspector General of Police for information and necessary compliance forthwith. 5.
