This revisional application has been filed against an order dated February 17, 2026 passed by the learned Civil Judge, VIII Bench, City Civil Court, Calcutta in Title Suit No.466 of 2026 whereby the petitioners’ prayer for ad interim injunction has been refused by the learned Trial Court. 2. An order passed under Order 39 Rules 1 and 2 of the Code of Civil Procedure is appealable under Order 43 Rule 1(r) of the Code. The revisional application is, therefore, not maintainable. The same is not fit to be entertained. 3. The petitioners shall be at liberty to take back the certified copy of the order impugned and take appropriate steps, in accordance with law. 4. At this juncture, learned advocate appearing for the petitioners submits that he seeks to withdraw the revisional application. 5. CO 776 of 2026 stands dismissed as withdrawn. 6.
