The petitioner has filed the present writ petition with following prayer: “It is, therefore humbly prayed that Your Lordship may graciously be pleased to accept and allow this writ petition and by an appropriate writ, order or direction:- 1. The respondents may be directed to consider the candidature of the humble petitioner under the MBC- Non-Creamy Layer category in view of the certificate of MBC Non-Creamy Layer issued on 03.01.2023, in favour of the humble petitioner and accordingly candidature of the petitioner may be considered for selection and appointment in pursuant to the advertisement dated 05.05.2023, for the post of Pharmacist with all consequential benefits in the interest of justice as per her merit position by [2026:RJ-JP:22338] (2 of 2) [CW-9328/2026] considering her candidature under MBC Non-Creamy Layer category in the interest of justice. 2. The lapse or mistake in the online application form in submitting MBC CL instead of MBC NCL may be ordered to be condoned in the interest of justice or the same may be directed to be revised in the interest of justice. 3. Any other appropriate order or direction as deemed fit in the facts and circumstances may also be passed in favour of the petitioner.“ 2. At the outset, learned counsel for the petitioner submits that the petitioner may be granted liberty to make a representation before the respondents in the light of order dated 02.01.2025 passed by Division Bench of this Court at Principal Seat, Jodhpur in D.B. Special Appeal (Writ) No. 1175/2024 decided on 02.01.2025. 3. In view of limited prayer made by learned counsel for the petitioner, this petition is disposed of with liberty to the petitioner to submit a representation before the Competent Authority, who shall consider and decide the same strictly in accordance with law within a period of three weeks from the date of receipt of representation along with certified copy of this order. 4.
