THE TAHSILDAR, ANEKAL TALUK ANEKAL - 562 106. …RESPONDENTS (BY SRI. MR.S.R.KHAMROZ KHAN, AGA) THIS WP IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECTING THE Digitally signed by JUANITA THEJESWINI Location: HIGH COURT OF KARNATAKA - 2 - HC-KAR NC: 2026:KHC:20408 WP No. 10099 of 2026 RESPONDENT TO CONSIDER THE REPRESENTATION DATED 08.03.2022 AS PER THE ANNX-C AND ETC. THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate is directed to take notice for all the respondents. 2. It is the contention of the petitioner that petitioner's grandfather late Sri. A. Vallabha Raju was granted 4 acres of land in Sy.No.53 of Kadujakkanahalli Village, Jigani Hobli, Anekal Taluk, in the year 1950. However the grantee's name was never entered in the revenue records. The petitioner's father Sri.Vasantha Raju also passed away in the year 1992. However at the request of the petitioner, the Tahsildar, Anekal Taluk has verified from the original records and found the information pertaining to the grant made in favour of the Sri.A.Vallaba Raju in terms of order bearing No.104/1950-51, to be genuine. Nevertheless the Tahsildar made a communication dated 06.06.2022 to the Assistant Commissioner, Bengaluru South Sub-Division seeking further - 3 - HC-KAR NC: 2026:KHC:20408 WP No. 10099 of 2026 orders for entering the name of the legal heirs of the original grantee in the revenue records. No orders have been passed by the Assistant Commissioner and therefore the prayer in the writ petition is to issue a writ of mandamus directing the respondent authorities to consider the representation dated 08.03.2022 at Annexure-C given by the petitioner to enter the name of the petitioner in the revenue records. 3. Having regard to the facts narrated hereinabove, this Court is of the considered opinion that it is the Tahsildar alone who is competent to consider the representation given by the petitioner. The Tahsildar need not have sought for orders at the hands of the Assistant Commissioner. If the original records reveal the fact that Sri. A. Vallabha Raju was granted the lands in question in an auction conducted by the competent authority, and if the grantee has paid the kimmat, then the petitioner has all the right to seek the entry of the names of the legal heirs of the original grantee in the revenue records. 4. Accordingly, writ petition stands disposed of with a specific direction to respondent No.3 - Tahsildar, Anekal Taluk to proceed to verify from the original records and as stated in - 4 - HC-KAR NC: 2026:KHC:20408 WP No. 10099 of 2026 the communication at Annexure-D dated 06.06.2022, if the original records do reveal the factum of the grant made in favour of Sri.A.Vallabha Raju, the Tahsildar may call for information from the petitioner regarding the legal heirs of the original grantee. The names of the legal heirs of the original grantee may be entered in the revenue records as expeditiously as possible and at any rate within a period of two months from the date of receipt of a copy of this order. Learned Additional Government Advocate is permitted to file memo of appearance within a period of four weeks from today. Sd/- (R DEVDAS) JUDGE GPG List No.: 1 Sl No.: 10
