Heard Mr. Harshmander Rastogi, learned counsel appearing for the petitioner. Also heard Mr. Samrath Singh appearing for the respondent. 2. This MCC has been registered on the basis of a PUD dated 19.01.2026 received from Hon’ble Mr. Justice V.K. Shrivastava, former Judge of this High Court, who was appointed as the Arbitrator from the side of respondent in ARBR No. 3/2025 vide order dated 03.11.2025 passed by this Court. Vide the said PUD, Mr. Justice Shrivastava has informed that he intends to recuse from the said proceedings because of his recent personal problems. 3. Mr. Samrath Singh, learned counsel appearing for the respondent submits PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.02.13 19:44:53 +0530 2 that in view of the above facts situation, a new Arbitrator from the side of the respondent would be required to be appointed by this Hon’ble Court and he proposes the name of Hon’ble Mr. Justice Deepak Kumar Tiwari, a former Judge of this High Court. 4. Learned counsel appearing for the applicant has no objection. 5. In view of the above, this Court deems it appropriate to appoint Hon’ble Mr. Justice Deepak Kumar Tiwari, a retired Judge of this High Court from the side of respondent in place of Hon’ble Mr. Justice Shrivastava, to be the Arbitrator and thereafter, Hon’ble Mr. Justice Minhajuddin as well as Mr. Tiwari may appoint the third Arbitrator. Thereafter, they may adjudicate upon the disputes and differences between the applicant and respondent arising out of and/ or in relation of agreement. 6. Accordingly, this MCC stands disposed of. 7. A copy of this order be communicated to Hon’ble Mr. Justice Deepak Kumar Tiwari as well as Hon’ble Mr. Justice Gulam Minhajuddin, retired Judges of this High Court, for information and necessary action, forthwith.
