ORDER:
This Contempt Case has been filed alleging willful disobedience of the interim order passed by this Court in W.P.No.9192 of 2018, dated 21.03.2018. 2.
This Court, while considering the matter on 21.03.2018, passed an interim order, the relevant portion of which reads as follows:
“In view of the interim order passed by this Court and after hearing the submissions of learned counsel on both sides, this Court passed interim order as per the resolution of the Gram Panchayat, Akividu, which is enclosed as Ex.P.5. The subject land was earlier allotted for the purpose of developing a park in memory of freedom fighter Sri Palli Lakshmi Narasimha Reddy and the park was already developed. The very same land was subsequently allotted for construction of a Sub-Treasury Office. Prima facie, such action is not valid. Hence, interim suspension, as prayed for.”

The respondents have filed a counter-affidavit stating that, pursuant to the orders of this Court, a report was submitted on 18.03.2026 to the Commissioner, requesting cancellation of Gram Panchayat Resolution No.238, dated 26.02.2007. It was stated that, even after a lapse of about 19 years, the park had not been developed pursuant to the said resolution and that the subject land was required for municipal development. 4. Subsequently, the Municipal Council, Akividu, passed Resolution No.273, dated 31.03.2026, cancelling the earlier resolution relating to the development of the park and installation of the statue of Sri Palli Lakshmi Narasimha Reddy. 4
5. It is further stated that the Municipal Authorities cleared the bushes and cleaned the subject land. However, the statue of the freedom fighter, late Sri Palli Lakshmi Narasimha Reddy, which had already been installed at the site, was not disturbed. 6. It is also relevant to note that the main writ petition was subsequently disposed of by this Court on 30.06.2026, directing the respondent authorities not to disturb the statue situated in the subject land except by following due process of law. From the material placed before this Court, it appears that the statue has not been disturbed. 7.
Thereafter, the District Collector, West Godavari, passed proceedings dated 05.08.2026, cancelling the proceedings of the then Collector, West Godavari, vide ROC.No.E4/e-1145576/2017, dated 31.01.2018, and consequential directions were issued to the Commissioner, Akividu, in respect of the development of the subject land. 8. Having regard to the above facts and circumstances, this Court is of the considered view that there is no sufficient material to establish that the respondents have willfully or deliberately violated the orders passed by this Court. The material placed before this Court also indicates that the statue of Sri Palli Lakshmi Narasimha Reddy has not been disturbed and that subsequent steps have been taken by the authorities in accordance with the orders passed by this Court. 5
9. Therefore, this Court is of the opinion that the interim order dated 21.03.2018 has substantially been complied with. In the absence of any clear and deliberate disobedience of the order of this Court, this Court is not inclined to proceed further in the contempt case. 10. Accordingly, the Contempt Case is closed, leaving it open to the petitioners to approach this Court in accordance with law, if they have any further grievance or in the event of any subsequent violation of the orders passed by this Court.
