Dutta, learned counsel for the petitioners. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State. This is an application under Section 482 of BNSS, 2023 for grant of pre- arrest bail in connection with Dispur P.S. Case No. 4/2026 under Section 61(2)/318(4)/308(3)/336(3)/340(2) of BNS, 2023. On perusal of the FIR of the case, it appears that the informant who is an advocate by profession has sought empanelment with United India Insurance Company and had submitted an application in this regard and subsequently, he was issued an appointment letter. But due to delay in generation of the Advocate Code, the petitioner, being under the apprehension that the appointment letter issued to him was fake, has lodged the instant FIR. In the said FIR, he has also alleged that some sort of indirect bribe was sought by the petitioners for empanelment. The appointment order issued to the informant has been annexed to the instant application as Annexure 8 and it is submitted that the same is a genuine one and there is no question of the petitioners who were officials of the company issuing any fake appointment letter. Subsequently, the Advocate Code Page No.# 3/3 was also issued as can be seen from Annexure 9. I find no reason to doubt the genuineness of the documents referred to herein above and it appears that the informant, under a false impression had lodged the instant FIR. Having regard to the above, it is provided that in the event of their arrest in connection with Dispur P.S. Case No. 4/2026 under Section 61(2)/318(4)/308(3)/336(3)/340(2) of BNS, 2023, the petitioners shall be released on bail on furnishing a bail bond of Rs. 20,000/- each with one surety each of like amount to the satisfaction of the Arresting Authority. It is also provided that the petitioners shall corporate with the investigation and shall appear before the I/O as and when called for. Petition stands disposed of accordingly.
