The instant petition is moved by the present applicant ‘Vinod Chaurasiya S/o Jeet Lal Chaurasiya along with the compounding application for quashing of proceeding of Criminal Case No. 723 of 2018 ‘State vs. Vinod Chaurasiya’ pending in the court of Additional Chief Judicial Magistrate, Vikas Nagar, District Dehradun, wherein, the present applicant is summoned to face the trial for the offences punishable under sections 498A, 323, 504 of IPC r/w section ¾ of the Dowry Prohibition Act arising out of Case Crime No. 61 of 2017. 5. The applicant is present in court and the respondent/complainant joined the proceeding through V.C. and both of them are identified by their respective counsel. 6. It is submitted in the compounding application that the dispute in between the parties is due the matrimonial discord, which has now been settled by both the parties and the divorce petition is already filed, which is pending for consideration. It is submitted that both the parties UKHC010126142026 2026:UHC:6152 have settled their matrimonial dispute, therefore, the proceedings be dropped. 7. The complainant also submits that she do not want to pursue the proceeding. 8. Learned State counsel have not objected on this since the parties have settled their matrimonial dispute and a divorce petition is filed by way of mutual consent, therefore, there is no useful purpose to continue the proceeding. 9. After hearing the submission of learned counsel for the parties and taking into consideration that the parties have settled their matrimonial dispute, therefore, there is no useful purpose to continue the proceeding. 10. In such view of the matter the present application as well as the compounding application are allowed and the entire proceeding of Criminal Case No. 723 of 2018 ‘State vs. Vinod Chaurasiya’ pending in the court of Additional Chief Judicial Magistrate, Vikas Nagar, District Dehradun, is hereby quashed.
