No. 1-155,Krishnayapalem, Mangalagiri Mandal,Guntur District. 2 ...Respondents Petition under Article 227 of the Constitution of India, praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to Aggrieved by the action of Learned Judge, III Additional District and Sessions Judge at Guntur, in not taking up and deciding IA.No. 8 of 2023 in AS.No.275 of 2019 and not deciding the main appeal, the petitioners begs to prefer this revision under Art. 227 of The Constitution of India IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to DIRECT the learned Judge, III Additional District and Sessions Judge: at Guntur, to take up and decide I.A. No. 8 of 2023 in AS No. 275 of 2019 and also the decide the main appeal as expeditiously as possible, pending disposal of main C.R.P. Counsel for the Petitioners: SREENIVASA RAO VELIVELA Counsel for the Respondents: The Court made the following order: 3 ORDER: The Civil Revision Petition is filed praying the Court to direct the learned III Additional District and Sessions Judge, Guntur to take up and decide I.A.No.08/2023 in A.S.No.275/2019 and also to decide the main appeal expeditiously. 2. 2. Initially the respondent no.3 herein filed a petition under Order XXII Rule 4 and under Section 151 CPC before the trial Court praying the Court to record that no legal representatives need be brought on record as the 1st respondent/1st defendant therein died on 11.8.2021 having executed an unregistered will dated 11.7.2021 in favour of the petitioner/appellant therein and the petitioner/appellant therein being already on record. As the said I.A. is dismissed, the parties have approached this Court and filed C.R.P.No.958 of 2024 and this Court considered the said Revision and disposed of vide order dated 18.02.2025 with the following directions: “In the result, the revision petition is allowed and the order and decree dated 23.02.2024 in I.A.No.08/2023 in A.S.No.275/2019 on the file of III Additional District Judge, Guntur is set aside and the matter is remanded giving liberty to the petitioner to implead in I.A.No.08/2023 the wife and daughter of the pre-deceased son by name Sri Peddi Srinivasa Rao, who are the other legal representatives of the deceased 1st respondent and thereafter the appellate Court shall order notice to them, conduct enquiry on the un-registered will dated 11.7.2021 of the 1st respondent and pass order afresh.” 3. Even lapse of more than sixteen (16) months, the said I.A. has not been considered and disposed of. Hence the C.R.P. 4 4. Considering the submissions and also on perusal of the record, the learned III Additional District Judge, Guntur is directed to consider the said I.A. and decide the same in terms of the order passed by this Court as referred above, and if the parties cooperate, the main appeal also may be considered for expeditious disposal. Accordingly, the Civil Revision Petition is disposed of. No costs.
