ARAVIND - 3 - HC-KAR NC: 2026:KHC:7438-DB WP No. 1892 of 2024 ORAL ORDER (PER: HON'BLE MR. JUSTICE S.G.PANDIT) Heard learned counsel Sri. Raghavendra G. Gayatri for the petitioner through video conferencing and learned Additional Government Advocate Sri.V. Shivareddy, for the respondents and perused the entire writ petition papers. 2. Learned counsel for the petitioner would submit that the petitioner was before the Karnataka State Administrative Tribunal at Bengaluru (for short 'the Tribunal') questioning the endorsement dated 27.10.2022 (Annexure- A25), whereunder the petitioner's request to consider for promotion to the next higher cadre of Assistant Director of Industrial Training is refused only on the ground of pendency of applications before the Tribunal. 3. Learned counsel for the petitioner would submit that most of the applications which were pending before the Tribunal are disposed of and he also submits that there is no interim order in any of the applications pending before the Tribunal not to effect any promotions. However, learned Additional Government Advocate filed memo dated 09.02.2026 - 4 - HC-KAR NC: 2026:KHC:7438-DB WP No. 1892 of 2024 enclosing the interim order dated 29.01.2025 in application No.6143-6149/2024 passed by the Tribunal whereunder, the operation and execution of Sl.Nos.5 and 6 in Notification No. CI.69.ICS.2021 dated 04.10.2024 is stayed. Learned counsel further submits that stay is in respect of Amendment to Cadre and Recruitment Rules. However, it is clear that there is no stay operating against effecting promotions. The Tribunal only on the ground that there is no promotional vacancy of Assistant Director of Industrial Training, refused to grant prayer of the petitioner. 4. On instructions, learned AGA Sri. V. Shivareddy would submit that there is vacancy of Assistant Director of Industrial Training as on this day and the State would consider the cases of the eligible officers in terms of the seniority of the cadre of Industrial Extension Officer and would take appropriate action. 5. In the light of the above submission, respondent Nos.1 to 3 are directed to consider the case of the petitioner and other eligible for promotion to the next higher cadre of Assistant Director of Industrial Training, if they are otherwise - 5 - HC-KAR NC: 2026:KHC:7438-DB WP No. 1892 of 2024 eligible according to the seniority and other eligibility conditions and pass appropriate orders in accordance with law.
