State has submitted a report. Let the same be kept with the record. The petitioner is in custody since 23rd July, 2019 and till date the prosecution has examined only three witnesses out of the 20 witnesses cited in the charge-sheet. Having considered the same as also the period of detention of the present petitioner, without entering into the merits of the case, I am of the view that further detention of the present petitioner is unwarranted in view of the incarceration already suffered. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Sahin Sk. shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees
2 Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Additional Sessions Judge, 2nd Fast Track Court, Berhampore, Murshidabad. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Murshidabad without prior intimation to the learned trial court. The petitioner shall also not enter into the jurisdiction of Jalangi Police Station till the evidence of Arejulla Sk, Basir Sk, Kiron Sk, Akkash Ali Sk and Hasanujjaman Sk is over. The petitioner for the next one year once in a fortnight will meet with the Officer-in-charge of the concerned police station wherein he would be residing and submit an acknowledgement before the learned trial court. Accordingly, CRM(M) 117 of 2026 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
