CRIMINAL PETITION NO: 6694 of 2026 The Court made the following Order:
Instant Criminal Petition, under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the petitioners herein (A1 to A3), seeking to quash the proceedings in SC No.40 of 2025 on the file of learned XIII Additional District and Sessions Judge Court, East Godavari District, Ramachandrapuram, for the offences punishable under Section 417 and 306 read with 34 of the Indian Penal Code,
1860. 2. Heard learned counsel for the petitioners and learned Assistant Public Prosecutor appearing on behalf of respondent - State. 3.
Learned counsel for the petitioners, after arguing for some time, has confined his argument to the extent of dispensing with the presence of the petitioners (A1 to A3) before the trial Court by submitting petitioners’ practical constraints in attending before the trial Court and states that petitioners shall not dispute his identity at a later stage of proceedings. Learned counsel seeks liberty to adjudicate all his grounds before the trial Court by filing of
4 discharge petition. He also states that trial Court not yet framed charges against the petitioners. 4. On the other hand, learned Assistant Public Prosecutor contended that there are no grounds to quash the proceedings at this stage. So far as dispensing with the presence of the petitioners before the trial Court, he has not opposed the same, including filing of a discharge petition by the petitioners. 5. Considering the facts and circumstances of the case, without expressing any opinion on merits and de-merits involved in the lis, the Criminal Petition is disposed of by granting liberty to the petitioners to file a discharge petition before the trial Court and on such filing, the learned trial Court shall dispose of the same in terms of the law only as expeditiously as possible. 6. Accordingly, the Criminal Petition is disposed of. 7. Till disposal of the discharge petition, presence of petitioners herein (A1 to A3) before the learned XIII Additional District and Sessions Judge Court, East Godavari District, Ramachandrapuram, in SC No.40 of 2025 is hereby dispensed with. 5
