The petitioner is apprehending his arrest in connection with Garhwa Mahila P.S. Case No.18 of 2025, registered for the offence under Section 64(2)(m) of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of the learned Chief Judicial Magistrate, Garhwa. 3. Learned counsel appearing for the petitioner submits that false allegation is made against the petitioner. She further submits that the petitioner and informant are major. She then submits that what has happened, that was consensual in nature. She next submits that false allegations are made of establishing relationship on the pretext of marriage. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of establishing relationship on the pretext of marriage. 5. Looking into the contents of the FIR, it transpires that on several times relationship was established between the petitioner and informant and they were in relationship since 26.12.2024 and the FIR has been lodged on 06.08.2025. A supplementary affidavit has been filed on behalf of the ( 2026:JHHC:1329 ) -2- A.B.A. No. 25 of 2026 petitioner, wherein, the complaint case filed by the complainant earlier, has been annexed and in the said complaint case, another story has been disclosed. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Garhwa in connection with Garhwa Mahila P.S. Case No.18 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated: 19th January, 2026 Ajay/
