Hon’ble Manoj Kumar Tiwari, J. Mr. R.P. Singh, Advocate for the petitioner. Mr. Rahul Verma, Additional Advocate General with Mr. Suyash Pant, Standing Counsel for the State.
2. Prayer for impleadment is not opposed.
3. For the reasons indicated, Impleadment Application (IA/3/2026) is allowed. Amended memo of parties be filed during the course of the day.
4. By means of this writ petition, petitioner has sought the following reliefs:
“(i) Issue a writ order or direction to the respondent no. 2 in the nature of the mandamus for immediately decide the petitioner representation dated 07/02/2023 (Annexure no. 8 to this writ petition) page no. 50-51.
(ii) Issue a writ order or directions to the respondents in the nature of the mandamus for immediately release the arrear payment of the petitioner.”
5. According to petitioner, his ancestors’ land was acquired by National Highways

2026:UHC:6158 Authority of India for construction of highway; however, only a small portion of compensation payable has been paid to petitioner.

Learned counsel for the petitioner submits that petitioner has made a representation to Special Land Acquisition Officer, Haridwar on 07.02.2023, which has not been considered so far.
7. Perusal of representation indicates that amount payable as compensation to the petitioner and his brother Vijay Singh was paid to Smt. Bala Devi and Smt. Rajdulari and petitioner had requested to recover the said amount from Bala Devi and Rajdulari and release it in favour of petitioner and his brother.

Since acquisition was made as per provisions of National Highways Act, 1956, therefore petitioner may approach the Competent Authority for Land Acquisition, who shall pass appropriate order, either for deciding the dispute himself or by referring the same to District Judge under Section 3H(4) of the said Act.
9. The writ petition is, accordingly,

disposed of with liberty to petitioner to approach the Competent Authority for Land Acquisition by moving application. Such application if moved shall be considered by the Competent Authority, as per law, within eight weeks of its receipt.
