No.646 of 2025 arising out of Katras (Ramkanali O.P.) P.S. Case No. 290 of 2025 for the offence registered under Section 103(1) of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Additional Sessions Judge- VI, Dhanbad, is pressed into motion. Petitioner is the mother, the deceased is her son and the case has been lodged by the wife of the deceased. As per the FIR, the deceased took Rs.100/- on the pretext of taking tea, but got liquor and under influence of Alcohol, started ransacking the house and assaulted the family members. In order to control him, he was tied down to a pole and despite this, he could not be pacified. Under the circumstance, the petitioner gave a Tangi blow to him, resulting in his death. It is submitted by the learned counsel on behalf of the petitioner that the offence under Section 103(1) of Bhartiya Nyaya Sanhita, 2023 will not be made out as the deceased was attempting to set the house on fire, therefore, the petitioner had acted in her self- defence. Learned A.P.P. opposed the bail petition. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
