JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 19.06.2026 Since both these bail applications arise out of the same FIR, the same are taken up together for disposal by this common order. 2. Heard Mr. S Das as well as Mr. G Chamuah, the learned counsel appearing for the petitioners. Also heard Mr. P Borthakur, the learned Additional Public Prosecutor for the state of Assam. 3. Both these applications are filed under Sections 482 & 483 of the BNSS, 2023, whereby the petitioner, namely, Nani Gopal Mandal @ Gopal Mondal in AB No.AB/1043/2026 has prayed for anticipatory bail apprehending his arrest in connection with Abhayapuri P.S. Case No.84/2026 and the petitioners, namely, 1. Noresh Mondal @Naresh Mandal, 2. Basona

Tusta Mondal @ Tusta Mandal @ Tushta Mandal in Bail Appln./1490/2026 have prayed for releasing them on bail after they were arrested in connection with Abhayapuri P.S. Case No.84/2026. 4. The petitioner Noresh Mandal @ Naresh Mandal is the father of Krishna Mandal. Similarly, Basona Mondal @ Bashana Mandal is the mother of Krishna Mandal, whereas Tusta Mondal @ Tusta Mandal @ Tushta Mandal is the brother of Krishna Mandal.
The petitioner Nani Gopal Mandal @ Gopal Mondal is the brother of Krishna Mandal. 5. The allegation against Krishna Mandal is that he had burnt alive the wife of Durga Mandal. Before an Executive Magistrate, Krishna Mandal has confessed his guilt. He has explained how he has killed his wife by burning her alive. 6. The aforesaid incident of burning of Durga Mandal took place near the house of the petitioners. 7. Mr. Borthakur has pointed out that the occurrence took place near the house of the petitioners and they cannot claim that they had no knowledge of the aforesaid incident. According to Mr. Borthakur the silence of the petitioner is culpable in nature. 8. I have considered the submissions made by the learned counsel of both sides. 9. The case diary reveals that Durga Mandal was killed by Krishna Mandal. Aparrt from that, there are no material to implicate the present petitioners with the aforesaid case. 10. Therefore, the petitioners, namely, Noresh Mondal @Naresh Mandal, Basona Mondal @ Bashana Mandal and Tusta Mondal @ Tusta Mandal @ Tushta Mandal do not deserve to be detained in custody for any further period of time. Therefore, their Bail Application/1490/2026 is allowed. 11. It is hereby directed that the petitioners 1. Noresh Mondal @Naresh Mandal, 2. Basona Mondal @ Bashana Mandal and 3. Tusta Mondal @ Tusta Mandal @ Tushta Mandal, who were arrested in connection with Abhayapuri P.S. Case No.84/2026, shall be released on bail of ₹25,000/- each with sureties of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate (M), North Salmara, Abhayapuri. 12. Similarly, the petitioner Nani Gopal Mandal @ Gopal Mondal also does not deserve to
Page No.# 4/4 be detained in custody. Therefore, his Anticipatory Bail Application No. 1043/2026 is allowed. 13.
It is hereby directed that in the event of arrest in connection with Abhayapuri P.S. Case No.84/2026, the petitioner Nani Gopal Mandal @ Gopal Mondal shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the arresting authority. With the aforesaid direction, both the applications are disposed of. The CD (s) shall be returned. JUDGE Comparing Assistant
