Public Prosecutor, Assam for the State respondent. 2. This anticipatory bail application has been filed by the petitioner namely, Sakir Ahmed @ Shakir Ahmed under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, with a prayer for granting pre-arrest bail in connection with Murajhar P.S. Case No. 221/2022 under Section 366 of the
Page No.# 2/3 IPC. 3. The TCR as called for has been received and the case pertains to 2022. The charge sheet in this case has been submitted way back on 29.10.2022 under Section 366 IPC. 4. The perusal of the materials on record, it appears that the petitioner had earlier approached before this Court by way of filing pre-arrest bail application which was dismissed with a direction that the petitioner shall approach before the learned trial Court. Upon such approach being made, the prayer for pre- arrest bail was rejected by the learned Addl. District & Sessions Judge, Hojai vide order dated 07.04.2026. Hence, fresh approach has been made by the petitioner by way of filing the instant pre-arrest bail application. 5. Having perused the materials on record and the fact that the investigation of the case has been over long ago, no fruitful purpose would be served by taking the petitioner into custody. Accordingly, prayer for pre-arrest bail is allowed. 6. It is directed that the petitioner above named be released on bail in the event of his arrest in connection with the aforementioned case, on furnishing a bond of Rs. 50,000/- (Rupees fifty thousand) only with one surety of the like amount to the satisfaction of the arresting authority/ Court. 7.
(a) It is provided that the petitioner shall appear before the Magistrate/Court where the case is pending within a period of ten days from today, (b) It is further provided that the petitioner shall participate in the trial as and when on commences and he shall not try to intimidate or influence any persons/ witnesses, or the victim acquainted with the facts of this case, in any
