Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter. Learned counsel further submits that the accused-applicant is an illiterate person and working as labourer. It is further submitted that accused-applicant has not committed any cyber fraud, [2026:RJ-JP:22912] (2 of 3) [CRLMB-2096/2026] however, the alleged fraud has been committed by the co-accused persons viz. Hidayat Tulla, Usha, Rakesh and Pappu Ram and while misusing the bank account of the accused-applicant they deposited an amount of Rs. 3,05,355/- in his bank account, as a result of which he has been implicated in this case. Learned counsel argues that there is no other criminal antecedents against the applicant-accused. On the other hand, learned Deputy Government Advocate opposes the bail application. 4. Heard learned counsel for the parties and also perused the material available on record. 5. Having regard to the facts and circumstances of the case and considering the facts that the accused-applicant is behind the bars since 15.01.2026; that the offences levelled against the accused- applicant are triable by the Magistrate; that there is no criminal antecedents against the applicant-accused; that the charge-sheet has been filed and trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicant. [2026:RJ-JP:22912] (3 of 3) [CRLMB-2096/2026] 6. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed.
