As these bail applications have been filed pertaining to the same FIR, they are being heard and decided by the instant common order. 2. These bail applications have been filed by the accused- applicants under Section 483 of the B.N.S.S, 2023 in the matter arising out of FIR No.69/2024, registered at Police Station SOG, District ATS & SOG, for the offences punishable under Sections 419, 420, 467, 468, 471 & 120B of IPC and 3,4 & 6 Rajasthan Public Examination (Prevention of unfair means) Act, 1992. 3. Learned counsel for the accused-applicants submits that the accused-applicants have falsely been implicated in this case. Learned counsel further submits that in this case the present accused-applicant namely Gitesh Jadon has allegedly arranged a dummy candidate to appear in Patwari Examination of 2021 in his place and applicant-accused Neeraj Kumar has allegedly appeared in place of accused-applicant-Gitesh Jadoun in aforesaid examination. Learned counsel contends that after investigation, charge sheet for the offences punishable under Sections 419, 420, 467, 468, 471 & 120B of IPC and 3,4 & 6 Rajasthan Public Examination (Prevention of unfair means) Act, 1992 has been filed before learned Chief Judicial Magistrate, Jaipur Metropolitan-II. Learned counsel further contends that offences levelled against the accused-applicants are triable by Judicial Magistrate. Learned counsel argues that accused-applicant-Gitesh Jadoun is physically disabled person having 40 per cent disability, who was arrested on 06.02.2026 and since then he is behind the bars and accused- [2026:RJ-JP:22848] (3 of 4) [CRLMB-4493/2026] applicant- Neeraj Kumar was arrested on 05.02.2026 and since then he is behind the bars. 4. Learned counsel further argues that there are no any criminal antecedent of the accused-applicants and trial will take long time to conclude, therefore, it is prayed that the accused- applicants be granted benefit of bail. 5. Learned Additional Advocate General appearing on behalf of the State vehemently opposes these bail applications and submits that allegations on accused-applicants are serious in nature, which have compromised the sanctity of the public examination, therefore, accused-applicants should not be enlarged on bail. 6. Heard learned counsel for the parties and also perused the material available on record. 7. Having regard to the facts and circumstances of the case; considering that charge sheet in this matter has been filed, offences levelled against the accused-applicants are triable by Magistrate and the trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow these bail applications filed by the accused-applicants. 8. Consequently, these bail applications filed under Section 483 of the B.N.S.S., 2023 are allowed. It is ordered that accused- applicants namely (1) Neeraj Kumar S/o Shri Rajesh Kumar, (2) Gitesh Jadon S/o Shri Shyam Singh arrested in connection with FIR No.69/2024, registered at Police Station SOG, District ATS & SOG, will be released on bail; provided each of them furnishes personal bond in the sum of Rs.1,00,000/- each and two [2026:RJ-JP:22848] (4 of 4) [CRLMB-4493/2026] solvent attested sureties of Rs.50,000/- each to the satisfaction of the learned trial Court.
