IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.2631 of 2026 Tophan Parida …. Petitioner(s) Mr. Partha Sarathi Das, Advocate -versus- State of Odisha …. Opposite Party(s) Mr. Debaraj Mohanty, AGA CORAM: JUSTICE SIBO SANKAR MISHRA Order No. ORDER 22.04.2026 01. 1. Heard. 2. The petitioner is seeking pre-arrest bail in connection with Kodala P.S. Case No.86 of 2012 corresponding to G.R. Case No.202 of 2012 (B) registered for the alleged commission of the offences punishable under Sections 147/ 148/ 294/ 323/ 324/ 307/302/506/120-B/149 of the IPC read with Sections 25(1-B)(a)/27 of the Arms Act, pending in the Court of the learned J.M.F.C., Kodala. 3. Learned counsel for the petitioner, on instruction from the petitioner, submits that except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R. 4. In the present case, the F.I.R. has been registered on 09.06.2012. It appears that the petitioner has been absconding since then. The anticipatory bail applications of the co-accused persons have already been dismissed by this Court. Since, the petitioner apprehends arrest, he has approached this Court by filing the present ABLAPL seeking anticipatory bail at this belated stage. 5. I am not inclined to entertain the present ABLAPL at this stage. However, the petitioner is directed to surrender before the learned trial Court on or before 10.05.2026 and move regular bail application. If such bail application is moved by the petitioner before the trial Court, the same shall be considered on its merit on the same day. 6. With the aforementioned observation, the ABLAPL is disposed of. (S.S. Mishra) Judge Subhasis Designation: Personal Assistant Location: High Court of Orissa, Cuttack.
