Opposite Party Mr. M.Mohanty,ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 30.03.2026 01. 1. The ABLAPLs are taken up together and disposed of by the following orders. p. 2 2. Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Singla P.S. Case No. 94 of 2021 corresponding to C.T. No.311 of 2021 pending in the Court of learned JMFC, Basta the grounds stated. 3. Mr. Panda, learned counsel for the petitioners submits that the present accused persons had earlier approached this Court vide ABLAPL No.1247 of 2023 disposed of on 9th February, 2023 allowing them to surrender before the learned court below to go on bail with conditions. It is submitted that the said order could not be availed of by the petitioners, hence, the present ABLAPLs. Mr. Panda, learned counsel would further submit that the petitioner in ABLAPL No.1870 of 2026 is having one antecedent, whereas, Sujay Jena@ Babu in ABLAPL No. 2734 of 2026 does not have any and in so far as the petitioner in ABLAPL No. 2803 of 2026, it is claimed by the State for him having antecedents. With the case diary produced, it is submitted to the Court by learned counsel for the State that the accused, namely, Ghanashyam Jena@ Hadibandhu Jena is having an antecedent for an offence under Section 103(2) BNS. The Court finds that the said case is of the year 2025. The other accused, namely, Sujay Jena @ Babu is stated to have no previous antecedent, but the co-accused, namely, Madhab Jena is having one. Though the accused, namely, Ghanashyam Jena@ Hadibandhu Jena is having antecedents including a case under Section103(2) BNS but earlier all of them including him were allowed to go on bail, p. 3 hence, this Court is inclined to direct them to surrender before the learned court below for being released with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioners surrender within a fortnight from today in connection with Singla P.S. Case No. 94 of 2021 corresponding to C.T. No.311 of 2021, it is directed that they shall be released on bail on furnishing a bail bond of Rs. 40,000/-(rupees forty thousand) each with one solvent surety for the like amount each with such other conditions imposed by the learned court below. The above order, as is further directed, shall not be given effect to only if the petitioners, namely, Madhab Jena and Ghanashyam Jena@ Hadibandhu Jena are having not more than one and two cases respectively and subject to compliance of other conditions imposed. 6.
