The present Second Appeal has been filed under Section 100 of the Code of Civil Procedure, 1908, assailing the judgment and decree dated 05.11.2016 passed by the learned District Judge, Jashpur in SOURABH BHILWAR Digitally signed by SOURABH BHILWAR Date: 2026.01.15 17:56:21 +0530 2 Civil Appeal No.02-A/2016, arising out of the judgment and decree dated 14.12.2015 passed by the Civil Judge, Class-II, Baghicha, Distt.- Jashpur in Civil Case No. 07-A/2013. 2. At the very outset, it has been observed by this Court that vide order dated 03/09/2025, a fixed date SPC was issued to the appellant as no one appeared on his behalf. As per Office report dated 14/10/2025, the SPC issued to the appellant was awaited, therefore, in the meantime, vide order dated 16/10/2025, a fresh fixed date SPC was issued for his appearance before this Court. However, as per Office report dated 29/10/2025, it has been reported that the sole appellant has died on 21/12/2022. 3. It has also been brought to the notice of this Court that during the pendency of the appeal, respondent No.1 has also died. 4. None appears nor any representation has been made on behalf of the appellant to prosecute the appeal, no legal representatives of the deceased appellant have been brought on record, nor has any application for bringing the legal representatives been filed within the prescribed period of limitation, and respondent No.1 has also died. 5.
