This Contempt Petition has been filed by the petitioner under Section 12 of the Contempt of Courts Act, r/w. Article 215 of Constitution of India alleging willful disobedience of the order dated 01.09.2021 passed by this Court in WP (S) No. 4587/2021. 2 2. Learned counsel for the petitioner submits that earlier the petitioner’s services were attached to Veterinary Hospital, Balod, District - Balod to Veterinary Hospital, Belauda, Block – Daundi, District – Balod. The order of attachment was put to challenge in writ petition bearing WP (S) No. 4587/2021 which came up for hearing on 01.09.2021 and this Court while considering the nature of grievance have stayed the effect and operation of the order challenged in that writ petition (order of attachment). The writ petition is still pending consideration and the interim order dated 01.09.2021 is still in existence. Respondent authorities have issued an order of transfer dated 30.06.2025 without seeking liberty from this Court and therefore, the respondent authorities have committed contempt of the order dated 01.09.2021 passed by this Court. 3. I have heard learned counsel for the petitioner and also perused the documents placed on record. 4. According to the submissions of counsel for the petitioner, order of attachment dated 02.08.2021 which was put to challenge in writ petition bearing WP (S) No. 4587/2021 is stayed vide order dated 01.09.2021. It is still in force. Interim order earlier granted in other petition is not an order mentioning that, status quo with respect to the placement of the petitioner be maintained. From the date of filing of earlier writ petition and interim order passed therein, petitioner has completed about more than 04 years in the present place of posting. The respondent authorities while considering the period of posting of the petitioner have passed an order of transfer of the petitioner along with other 61 employees. It is a fresh transfer order and not any order or action of the respondents to give effect to the order dated 02.08.2021. 5. In the above facts of the case, where the petitioner is transferred after completion of normal tenure of service at a particular place and it is not the case where the respondents have acted upon an order which is stayed by 3 this Court, in the opinion of this Court, it is not an act of the disregarding order passed by this Court or in any manner committing contempt of the order of this Court. 6. For the foregoing discussion, the contempt petition is dismissed. 7. Certified copy as per rules.
