Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioners for grant of regular bail for the offences registered under Sections 111(2)(b), 111(3), 111(4), 271, 272, 274, 341(3), 348, 349, 350 of Bhartiya Nyaya Sanhita, 2023 and under Section 47(a), 52, 55 of the Jharkhand Excise Act in connection with Panki PS Case No. 153 of 2025.

Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence as alleged in the FIR. He submits that the petitioners have no concern or connection with the alleged offence of illegal manufacturing and transportation of the recovered English wine nor with the place of offence in any manner. He further submits that co-accused, namely, Azaz Alam @ Ejaz Alam and Arif Ansari in B.A No. 629 of 2026 have been granted bail by the Co-ordinate Bench of this Court and the petitioners are in custody since 10.12.2025 as such the petitioners may kindly be enlarged on bail.

Learned APP opposes the prayer for bail of the petitioners.

Having regard to the fact that the co-accused, namely, Azaz Alam @ Ejaz Alam and Arif Ansari in B.A No. 629 of 2026 have been

granted bail by the Co-ordinate Bench of this Court and the petitioners are in custody since 10.12.2025, I am inclined to enlarge the petitioners on bail. Accordingly, the petitioners, above-named, are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj in connection with Panki PS Case No. 153 of 2025.

It is made clear that the petitioners shall appear on each and every date before the learned trial Court and they shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioners, learned trial Court shall be at liberty to cancel the bail of the above-named petitioners.

Accordingly, the instant bail application stands allowed.
