Mr. M.C. Pant, learned counsel for petitioner, appeared through video conferencing.
2. Mr. Suyash Pant, learned Standing Counsel with Mr. B.S. Koranga, learned Brief Holder for the State of Uttarakhand/ respondent No.1.
3. This writ petition has been filed by petitioner for the following reliefs:- I. Issue a writ, order or direction in the nature of Mandamus directing Respondent No.1 to take immediate and appropriate action for issuing necessary directions to Respondent No.2 so as to ensure that the Petitioner is not obstructed, hindered, or interfered with in the performance of his religious duties and rites as an authorized priest of the Chandi Devi Temple, Haridwar and to pay him the regular salary/remuneration/ honorarium and customary emoluments attached to the office of Pujari, as were being paid priorly or to mould the relief appropriately by safeguarding the interest of the Petitioner keeping in view the facts highlighted in the body of the Petition. II. To pass appropriate order or direction to conduct an inquiry by appointing an independent agency on the aspect of corruption and manipulation which is to be monitored by this Hon’ble Court to fix the responsibilities on erring persons in accordance with the law or to mould the relief appropriately by safeguarding the interest of the Petitioner keeping in view the facts highlighted in the body of the Petition.
4. From bare reading of the prayers, it appears that it can only be granted in a
2026:UHC:689 Civil Suit by a Civil Court.
5. In such view of the matter, the present writ petition is not maintainable and the same is accordingly dismissed with liberty to the petitioner to avail appropriate remedy available under civil law.
