ORAL ORDER:
Heard Sri M.V.S. Nikhil Kashyap, learned Counsel appearing on behalf of Sri K.S.S. Sanjay, learned Counsel for the Writ Petitioner, Sri M. Srinu Babu, learned Assistant Government Pleader for Municipal Administration & Urban Development and Smt. Sireesha Rani Vallabhaneni, learned Standing Counsel for Respondent No.3. 2. In compliance with the Order of this Court dated 10.04.2026, the Writ Petitioner has filed a Sworn Affidavit on a Rs.100/- Non-Judicial Stamp Paper, duly notarized, stating that he would vacate the premises on or before 04:00 P.M on 30.05.2026. This Affidavit is taken on record. The relevant portion of the Affidavit is usefully extracted hereunder:
“I submit that the I have filed the writ petition W.P. No: 9538 of 2026 is being filed aggrieved by the action of the action of respondent.
No: 3 in issuing the notice dated: 20.03.2026 and as per the directions of this Hon'ble court, when the matter came up for admission on 10.04.2026, I respectfully submit that, I am willing to vacate the scheduled premises in which currently the business is taking place on or before 30.05.2026 by 04:00 Pm, as I am already constructing my new shop in other premises at commercial area, therefore I request this Hon'ble court to kindly consider my undertaking and direct the official respondents (Nandigama Municipality) to not to interfere with my business till 30.05.2026 04:00 PM in the interest of justice and pass such other order or orders which this Hon'ble court may deem fit and proper in the facts and circumstances of the case.”
3. In terms of the above extract, this Writ Petition is disposed of, with liberty to the Respondents to initiate process of eviction, in the event of default
