GP FOR ENDOWMENTS The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.22507 OF 2026 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue a writ, order or direction, more particularly one in the nature of a Writ of Mandamus, declaring the inaction of the respondents in not considering the representation dated 16.03.2026 submitted by the petitioner and in failing to initiate action for eviction of the unauthorized occupant, namely the 4TH respondent, from Shop No.14 bearing Door No.2-3-63 situated opposite Karna Bhaktha Satram, Srisailam Temple, Srisailam as illegal, arbitrary, unreasonable, violative of Articles 14, 21 and 46 of the Constitution of India and contrary to the provisions of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987, and consequently direct the respondents evict the unauthorized occupation of the 4TH respondent from the subject shop and restore vacant possession thereof to the petitioner, and pass such other order or orders.…” 2. The grievance of the petitioner is that the temple allotted Shop No.14, bearing Municipal Door No.2-3-63, situated opposite to Karna Bhaktha Satram, Srisailam, in or around the year 1983, on a lease basis. Subsequently, the petitioner has been continuing as lease holder of the same shop. The 4th respondent occupied the said shop. Therefore, the petitioner herein submitted an application / representation dated 16.03.2026 with a request to evict the 4th respondent from the said shop and to restore the vacant possession to the petitioner. Despite lapse of four months, there is no action from the respondents. Hence, the present Writ Petition is filed to direct the respondent No.3 to address the petitioner’s representation dated 16.03.2026. 4 4. Heard learned counsel for the petitioner, learned Assistant Government Pleader for Endowments appearing on behalf of respondent No.1 and learned Standing Counsel appearing on behalf of respondent Nos.2 and 3. 5. As the relief sought is innocuous, this Court is of the view that keeping the Writ Petition pending and inviting a counter-affidavit will not serve any purpose. 6. Hence, with the consent of learned counsel appearing on either side, the present Writ Petition is disposed of, at the admission stage, directing the 3rd respondent to examine the petitioner’s representation dated 16.03.2026, and pass appropriate orders in accordance with law, and communicate the decision to the petitioner within a period of four (04) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
