3. License granted to petitioner under Legal Metrology Act, 2009 was cancelled by the Licensing Authority/Controller of Legal Metrology, Uttarakhand, vide order dated 21.08.2025.
4. Since appeal against cancellation
order is provided under Section 50 (1) (e) of Legal Metrology Act, 2009 and Rule 26 of Uttarakhand Legal Metrology (Enforcement) Rules, 2012, therefore, petitioner has preferred an appeal against the order passed by Licensing Authority. No decision has been taken on that appeal, therefore, petitioner has approached this Court seeking the following reliefs:-
“i) Issue a writ of certiorari quashing the order dated 21.08.2025 (Annexure No. 1) (Page No. 14-16) passed by the respondent no. 3, whereby the licence of the petitioner issued under the provisions of Legal Metrology Act, 2009 has been cancelled on the basis of false and frivolous complaint made

ii) Issue a writ, order or direction in the nature of mandamus directing and commanding the Appellate Authority constituted under the provisions of the Legal Metrology Act, 2009 to decide the statutory appeal preferred by the petitioner under Section 50 of the Legal Mettrology Act, 2009 in a time bou7nd manner, as stipulated by this Hon’ble Court.”

Learned counsel for the petitioner submits that appeal was filed on
20.09.2025.
6. Since nearly 10 months have gone by since filing of the appeal, therefore, the writ petition is disposed of with a direction to the Appellate Authority to consider and decide petitioner’s appeal, one way or the other, within ten weeks from the date of presentation of certified copy of this order.
