In this petition filed under Section 528 of Bhartiya Nagarik Surksha Sanhita, 2023, the petitioner seek a direction for early disposal of Complaint Case No. 171/2023 pending before the Judicial Magistrate First Class, Kharsia, District Raigarh (C.G.). 2. Learned counsel for the petitioners submits that the aforesaid criminal case was registered in the year 2023, but despite the 2 lapse of more than 2 years, the trial has not yet been concluded. He further submits that the petitioners are willing to keep their adopted daughter, Khushi @ Meethi, but due to the pendency of the criminal case, they are unable to do so. Therefore, through this petition, the petitioner seeks a direction to expedite and conclude the criminal case within a stipulated time, without challenging any specific order. 3. Learned State counsel opposes the submission made by learned counsel for the petitioner. 4. I have heard learned Counsel appearing for the parties and perused the documents annexed with the petition including the order sheets of the Trial Court. 5. Section 528 is engrafted to allow the High Court to intervene in cases where there is a clear abuse of process or where it is necessary to prevent injustice. It is not meant to manage the trial process and specific timelines for disposal. Therefore, I am not inclined to direct the trial Court to expedite and conclude the trial in a time bound manner. 6.
