1. The instant bail application has been filed under Section 483 of BNSS by the petitioner Amin Pathan S/o Sokat Khan, who was arrested by the police in connection with the FIR No.58/2026 dated 08.02.2026 registered at Police Station Bhawani Mandi, District Jhalawar for the offences punishable under Sections 8, 22 and 29 of the NDPS Act, 1985.

Learned counsel for the petitioner submits that the alleged contraband substance (MDMA) as recovered in the case is quantified as 10 gms which is equivalent to the commercial quantity as prescribed under the Act of 1985, although the polythene bag has not been separately weighted. In view thereof, he prayed that the petitioner be enlarged on bail.
3. Learned Public Prosecutor strongly opposesd the bail application by submitting that petitioner herein has six

He further submits that the petitioner also has two cases under NDPS Act of the year 2024 and 2025 against them. In view thereof, he prayed that the present case is not a fit case to enlarge the present petitioner on bail.

This Court considering the nature of allegations and more particularly that he has two cases under NDPS Act of the year 2024 and 2025 and the present case is the third one and that in the past, there are other antecedents against the petitioner, this Court is not inclined to enlarge the present petitioner on bail.
5. Accordingly, the instant bail application preferred on behalf of the petitioner is dismissed.
