Petitioner owns agricultural land in Village Phetshaal, District Almora. Power Transmission Corporation Ltd. was erecting transmission line in village Phetshaal and electricity towers were installed on the land of the petitioner, therefore, he filed this writ petition in the year 2018, seeking the following reliefs:- (i) Issue a writ of certiorari to quash the High Tension Electric Line 132 K.V.A. from Nairi to Bageshwar over the khet (plot) fo the petitioner, village, Basulishera, post Bhagwaali Pokhar, Tehsil Dhwarahat District Almora and call for the record. (ii) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents not to draw/carry the High Tension Electricity Line 132 K.V.A. from Nairi to Bageshwar over the khet (plot) of the petitioner, village Basullishera, post Bhagwaali Pokhar, Tehsil Dhwarahat District Almora. Mr. Vinay Kumar, learned counsel for Power Transmission Corporation Ltd. submits that work of erection of transmission line must have been completed by now, therefore, according to him, the writ petition has become infructuous. 6. Since petitioner sought a writ of mandamus, without approaching the Competent Authority, therefore, this Court thinks that ends of justice would be met if petitioner is permitted to make representation to the Competent Authority in Power Transmission Corporation Ltd. 7. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation to respondent no. 3. If petitioner makes representation within two weeks from today, decision thereupon shall be taken by respondent no. 3, as per law, within three months thereafter.
