THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM CRIMINAL PETITION NO: 6329 of 2026 The Court made the following Order:
Instant Criminal Petition, under Section 528 of the Bharatiya Nagarik Suraksha Sanhitha, 2023, has been filed on behalf of the petitioner herein (Accused), seeking to extend the time for deposit of 20% of the compensation amount pursuant to the order dated 05.05.2026 in Crl.M.P.No.190 of 2026 in Crl.A.No.98 of 2026 on the file of the II Additional Sessions Judge, Guntur.

Learned counsel for the petitioner submits that pursuant to the orders of this Court dated 28.07.2026, he has served notice to respondent No.2 and filed proof of service memo vide USR No.85804 of 2026. However, there is no representation for respondent No.2.
3. Heard. Perused the entire available material on record.

Learned counsel for the petitioner, after arguing for some time, confined his argument to the extent of enlargement of time to deposit 20% of the compensation amount imposed by the learned Sessions Judge in the order dated 05.05.2026, for further reasonable period, by citing health grounds which affected the petitioner’s financial capacity.

5. On the other hand, Sri K. Sandeep, learned Assistant Public Prosecutor, did not oppose the same.
6. Considering the submissions made, more particularly, taking note of the petitioner’s financial inability, the criminal petition is
disposed of granting four (04) weeks time from today, to the petitioner, so as to comply with the order dated 05.05.2026 in Crl.M.P.No.190 of 2026 in Crl.A.No.98 of 2026, on the file of II Additional Sessions Judge, Guntur.
7. Till such time, it is made clear that respondent/police shall not take any coercive steps against the petitioner herein.
8. There shall be no order as to costs. Miscellaneous petitions, if any pending shall stand closed.
