BEFORE HONOURABLE MR. JUSTICE SANJAY KUMAR MEDHI ORDER 17.06.2026 Heard Ms. P. Sarma, learned counsel for the petitioner, who by means of this application has prayed for a direction for release of bills owing to giving two vehicles on hire to the Home Department. Shri S. R. Baruah, learned State Counsel has however submitted that there is an inherent defect in the presentation of the petition which involves two vehicles and the second vehicle is not owned by the petitioner. This Court has also noticed that there is no acknowledgment of the dues by the Head of the Department which is an essential requirement as laid down by the Hon’ble Full Bench in the case of Tamsher Ali Vs State of Assam reported in 2008 (4) GLT 1. At this stage, Ms. Sarma, the learned counsel for the petitioner submits that she would withdraw the writ petition. She however prays for a liberty to file afresh with proper documents. In view of above, writ petition is dismissed on withdrawal with liberty as prayed for. JUDGE Comparing Assistant
