ORDER:
The writ petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, or any other appropriate writ,
order or direction, declaring the action of the respondent No. 2 to issue N.O.C. for the sale of the petitioner’s property situated in Sy. No. 382 to an extent of Ac. 4.50 cents in Madhuravada Village, Visakhapatnam District, despite completion of the statutory period as per G.O.Ms.No. 1117, as illegal, arbitrary, without jurisdiction and in violation of the principles of natural justice and Article 300-A of the Constitution of India; and consequently, direct the respondent No. 2 to forthwith issue N.O.C. for the sale rights of the said property and pass such other order as this Court deems fit.
2. Sri G. Divyatheja, learned Assistant Government Pleader for Revenue, is present.
3. Sri N. Krishna Sai, learned counsel for the petitioner submitted that he had filed vakalt for the petitioner on 01.08.2026 and the same is pending for scrutiny. He further sought permission of this Court to withdraw the writ petition with liberty to file a fresh writ petition and made an endorsement on the file to that effect.
4. Accordingly, the writ petition is dismissed as withdrawn granting liberty to the petitioner, as prayed for. No costs.
Interim order granted earlier, if any, shall stand vacated.
Pending miscellaneous applications, if any, shall stand closed.
